Holidays in Arezzo – Terms and conditions

PREAMBLE

Definitions

Purchaser: the person who purchases Holidays in Arezzo.

Beneficiary: the person who uses the voucher in Holidays in Arezzo.

Product: Holidays in Arezzo smartbox containing 1 voucher valid for 1 or 2 nights in an accommodation facility in Arezzo, map and guide to the city of Arezzo.

Foundation: Arezzo Intour Foundation.

Object and scope of the General Conditions for the use of the product

The Foundation, in its capacity as a promoter of tourism in Arezzo, markets the product as well as assisting the Beneficiary in the booking procedure.

The purpose of these General Terms and Conditions is to set out the terms and conditions for the use of the Voucher included in the product, directly by the Beneficiary through customer service, in order to book the stay.

They may be changed without prior notice and only the general terms and conditions of use in force on the day of booking apply.

These General Booking Conditions are valid from 31/10/2021, and supersede and replace all previous versions of these conditions.

ARTICLE 1: FORMATION OF THE CONTRACT AND THE BOOKING PROCESS

To book a facility, the Beneficiary should contact the Foundation’s Customer Service at organizzazione@arezzointour.it specifying:

  • first name and last name
  • voucher/ticket number
  • date of arrival

The Foundation will notify the Beneficiary of the name and address of the facility within 48 hours of departure. The allocation of the facility will be at the discretion of the Foundation depending on the availability of each facility. Requests to agree on the facility before purchasing the Voucher will not be considered.

The voucher does not cover the cost of the tourist tax, which the Beneficiary will have to pay directly at the assigned accommodation.

In case of no show or cancellation the cost of the product will not be refunded.

If there is no accommodation available on the selected date, the Beneficiary may choose a new date.

The request to use the Voucher must be received at least 1 week before the date of the requested stay.

The voucher cannot be used in the period included from the second weekend of November to the second weekend of January (of the following year).

ARTICLE 2: ABSENCE OF A RIGHT OF WITHDRAWAL

It is explicitly recalled that under the terms of the provisions of the Consumer Code, the Beneficiary will not be able to exercise the right of withdrawal in respect of accommodation services in particular.

ARTICLE 3: MODIFICATION AND CANCELLATION OF RESERVATION

A ‘change’ is defined as a change of date at the same establishment. Other cases will be considered as a cancellation.

Article 3.1: Unavailability, modification or cancellation of the reservation due to liability on the part of the Foundation or the selected establishment.

The utmost care is taken to update availability made directly by the establishments. However, in the event of exceptional and unavoidable circumstances, the establishment may cancel the reservation made by informing the Beneficiary of this cancellation, without undue delay, before the start of the departure.

No compensation shall be due by the Foundation to the Beneficiary or the purchaser.

The Foundation may then propose to the Beneficiary:

– to find, with the Foundation’s help, another date of availability at the originally chosen venue,

– or to find, with the Foundation’s help, another facility on the date originally chosen.

In any case, the reservation will be cancelled free of charge.

The Voucher shall therefore be reactivated.

Article 3.2: Modification or cancellation of reservation due to liability of the Beneficiary

The Beneficiary may cancel the reservation with the assigned establishment at any time before the start of the stay, on the understanding that specific terms dictated by the establishment may apply.

Unless otherwise indicated and in accordance with the provisions of Articles 32(2) and 33(1)(c) of Legislative Decree No. 79/2011, as amended, the Beneficiary may decide to cancel his or her booking without charge up to 72 hours before the check-in date.

In the event that the stay is cancelled in less than 72 hours (or for other specific terms that may apply) before the check-in date, the Voucher will be considered as used by the Beneficiary and will be lost.

Notwithstanding the above, a stay that is interrupted, shortened or not enjoyed due to the responsibility of the Beneficiary, for any reason whatsoever, particularly in the event of no-show or late arrival at the establishment, shall not give rise to any reimbursement, and the Voucher shall be considered to have been duly used.

The cancellation or change request must be communicated to Customer Services by email to organizzazione@arezzointour.it;

ARTICLE 4: EXCLUSION AND LIMITATION OF LIABILITY

The Purchaser must be particularly vigilant when entering data and addresses, in particular identity and personal data. To this end, he/she warrants to the Foundation that all information provided is accurate, up-to-date and not misleading in any way. The Purchaser is informed and agrees that the information entered is valid as proof of his identity. 

ARTICLE 5: CUSTOMER SERVICE

Requests for information and clarifications concerning, in particular, booking, reimbursement and the operation of the Voucher should be addressed to organizzazione@arezzointour.it.

ARTICLE 6: PERSONAL DATA

The Purchaser and the Beneficiary are informed and accept that the Foundation collects and processes all personal data provided during the purchase and the Voucher activation request. The Foundation’s data protection policy is explained in detail at https://www.discoverarezzo.com/privacy/.

ARTICLE 7: COMPETENT COURT – SETTLEMENT OF DISPUTES

With regard to any disputes, the parties undertake, prior to any litigation, to seek an amicable solution in good faith within a period of thirty (30) days. 

If no amicable agreement is reached, the dispute shall be submitted to the exclusive jurisdiction of the Court of the place where the Foundation is domiciled, unless mandatory rules of procedure dictate otherwise.
